US Court Rejects xAI Lawsuit Against OpenAI Over Trade Secrets Claims!

The legal battle between Elon Musk and OpenAI has hit another setback. A U.S. federal judge has dismissed a lawsuit filed by Musk’s AI company xAI, which accused OpenAI of obtaining trade secrets related to its Grok chatbot through a former employee. The ruling marks Musk’s second courtroom loss against OpenAI in less than a month.

A federal judge in San Francisco dismissed xAI’s trade secret lawsuit against OpenAI, ruling that the company failed to provide evidence that OpenAI encouraged a former xAI engineer to share confidential information.

U.S. District Judge Rita Lin said xAI did not show that former senior engineer Xuechen Li disclosed trade secrets to OpenAI or that OpenAI employees knew any confidential information may have been shared. The judge dismissed the case with prejudice, meaning it cannot be filed again, stating that further amendments would be "futile."

The lawsuit, first filed in September, originally alleged that former xAI employees took confidential information, including source code, when joining OpenAI. An amended complaint later focused on a presentation Li reportedly gave during OpenAI’s recruitment process.

xAI argued that OpenAI sought information related to Grok 4 ahead of its July 2025 release because its own ChatGPT updates "could not compete" on complex reasoning and because OpenAI was "lagging" in reinforcement learning and post training techniques.

However, Judge Lin rejected that argument, saying discussions about previous work are common during hiring processes. "To hold otherwise would potentially expose employers to liability any time they inquire about a candidate’s past work," Lin wrote.
 
OpenAI welcomed the ruling and said, "This baseless lawsuit was never anything more ‌than yet ⁠another front in Mr. Musk's ongoing campaign of harassment."

OpenAI has maintained that Li never worked for the company and that it never acquired xAI trade secrets. Li is also facing a separate lawsuit from xAI and has denied any wrongdoing.
The decision comes weeks after Musk lost another major case against OpenAI, in which a federal jury rejected claims that the company had abandoned its original nonprofit mission for financial gain.

The ruling brings another round of legal clarity in a closely watched dispute, but also keeps the broader tensions in the AI space in focus as competition and courtroom battles continue to run in parallel.
